If you have a lawsuit that actually goes to court, the judge will instruct the jury on the various elements of damages that are involved in the case. Those elements of damages can include things such as your medical expenses, your lost wages, your physical pain and mental suffering, permanent injuries and disabilities, future medical expenses, future lost income, future pain and suffering. So there’s all sorts of damages, and this is what the law says in the books that this law fits in, there are a lot of laws. They would probably fill this room.
But the lawyers get together with the judge and determine what law applies to the case. The judge instructs the jury on the law that applies, and that includes the various elements of damages in a case.
