What is Personal Injury Law?

Hi. I’m personal injury and disability attorney David Daggett, of the law firm Daggett Shuler. Today I’m going to talk about, what is personal injury law and how can a person protect their rights?

A question I’m often asked is whether or not people need to hire a lawyer to handle their personal injury claim. The answer is, ‘that depends.’ When an accident or serious injury occurs and keeps you out of work, leaves you with disability or scaring because it was someone else’s fault, there’s laws that protect the individual or family of the injured party. Oftentimes, the effects can be devastating and long-lasting. Many times, the whole family suffers.

Each personal injury situation is different and requires a thorough investigation to get to the facts. Some examples of a personal injury include an automobile accident where somebody drinking and driving is at fault, or you’re crossing the street in a crosswalk and somebody hits you, or how about if you’re in a store and a heavy display item falls on you?

It’s very frustrating being a victim of a personal injury because someone else was careless. It’s even worse when you don’t understand the law and the process of getting your claim resolved. Often, one of the first questions asked by someone who’s been injured in an accident is, ‘What is my case worth?’ The only way to offer a valid opinion is to investigate all the facts, review the medical records and bills, and find out if the person has permanent injuries. Also check and see how much insurance is available. A good personal injury attorney should walk you through all those processes.

An experienced personal injury lawyer will know all the laws and will have a keen knowledge of how to work with the insurance companies to secure the most favorable and just settlement to cover all the losses associated with an accident. All personal injury claims are not alike. Each one is very different and requires a different strategic approach. A personal injury claim is normally handled on a contingency fee basis. This means that there would be no upfront cost at all to work with an attorney, the attorney is only paid if your case is concluded successfully. Not only are personal injury claims handled on a contingency fee basis, but a claimant should also expect to receive a free initial consultation with a lawyer. There is no pressure on you and there is no charge.

It is important for you to understand that it is your right to be compensated for your personal injuries that were not your fault, that’s why we have insurance. It is a proven fact that an experienced personal injury attorney can secure a much larger settlement on average from an insurance company than an injured person can collect on their own.

After an accident when injuries and losses are sustained, and it wasn’t your fault, you need an experienced personal injury law firm to help protect your rights.
