Handling a Slip & Fall Accident Claim in NC Can Be Difficult, But Not Impossible

Slip and fall accidents occur often, and many times on public properties, state and federal properties, commercial as well as residential. In North Carolina it is difficult for victims of slip and fall accidents to seek the damages they need for their injuries and medical expenses due to the current laws. Now it is difficult, but not impossible.

After a serious fall due to a property that was not maintained properly, you could be facing mounting medical bills for injuries sustained, and on top of that, you could also have to deal with a company or property owner that refuses to take responsibility. In a situation like this, you really should work with an experienced premises liability attorney.

North Carolina resident Barry Turner recently suffered broken ribs and other injuries during a routine weekend trip to his local Wal-Mart. At first Wal-Mart seemed to be cooperative, but then they stopped. Mr. Turner had slipped and fallen in an area of Wal-Mart where the floor was unsafe and he suffered serious injuries. Mr. Turner and his family are now facing mounting medical bills for his injuries, and Wal-Mart has been unresponsive to his situation.

WFMY CBS 2 recently examined Mr. Turner’s case against Wal-Mart, and turned to Daggett Shuler Law Attorney and Partner David Daggett for his legal opinion. Attorney Daggett explained that in North Carolina, the law makes it extremely difficult for people that are injured in slip and fall accidents to get the compensation they need for their injuries and medical expenses.

David Daggett provided these tips for North Carolina residents who suffer an injury in a fall that was caused by negligence:

  • Report the incident as quickly as possible. The longer you wait to notify the company or property owner about your fall and the dangerous conditions, the harder it becomes to argue your case.
  • Find any witnesses that can confirm your claim. This will make your case much stronger if the property owner tries to deny responsibility.
